His response appeared in "letters to the editor" section of today's (27/5) &lt;a href="http://www.theglobeandmail.com/"&gt;&lt;span style="color:#ff0000;"&gt;Globe and Mail&lt;/span&gt;&lt;/a&gt;.&lt;br /&gt;&lt;br /&gt;Democracy in Egypt&lt;br /&gt;DR. MAHMOUD EL-SAEED&lt;br /&gt;Egyptian Ambassador&lt;br /&gt;Ottawa -- The writers of the article Ray Of Hope: 'Revolution Of The Judges' (May 25) were apparently grossly misinformed about developments in Egypt. Political, economic and social reform started in Egypt more than 20 years ago. Such changes are very difficult and take time. Our region faces many local and regional challenges that complicate the process of reform.&lt;br /&gt;Speaking about a revolution of the judges is fanciful. The dispute taking place in Egypt has nothing to do with the government; it is among the judges themselves. Two judges insulted other judges in the media. So, the Supreme Judicial Council, consisting of only judges, has initiated disciplinary action against them.&lt;br /&gt;The government refused to interfere in the dispute out of respect for the independence of the judiciary, which is strictly guaranteed by the Constitution. On the other hand, the Muslim Brotherhood, an illegal extremist group, tried to use the conflict to achieve political goals. Demonstrators blocked traffic and disrupted public order in a way that compelled security forces to intervene. The demonstrators were not so peaceful as the writers claim.&lt;br /&gt;Regarding the extension of emergency law in Egypt, what the writers failed to mention is that it was extended only temporarily while two committees in the upper and lower chambers of the Egyptian Parliament work hard on drafting a new anti-terrorism law. It would be irresponsible to create a legal vacuum while Egypt is still facing the threat of terrorism.&lt;br /&gt;Egypt is steadily on the road to democracy. Political life and debate in Egypt are free and very energetic. There is no wavering in our resolve to proceed. Cet amendement a été présenté par le gouvernement égyptien et ses supporters comme étant le début d'un important processus de réformes démocratiques.&lt;br /&gt;Cependant, les partis d'opposition et les organisations issues de la société civile ont critiqué cet amendement constitutionnel, jugeant qu'il était essentiellement cosmétique, ne donnant que l'illusion d'un pluralisme politique. En effet, les conditions d'admissibilité aux élections présidentielles sont tellement contraignantes que seul le président Moubarak pourrait se présenter aux élections ! Afin de calmer les critiques, le gouvernement égyptien a décrété la suspension temporaire de ces conditions contraignantes, uniquement pour la première élection suivant la réforme, ce qui a permis la tenue de l'élection présidentielle de 2005. Lors du référendum sur cet amendement constitutionnel, en mai 2005, des manifestants avaient été battus par des agents gouvernementaux avec la complicité de la police égyptienne. Or ces manifestants ne faisaient rien d'autre qu'exprimer pacifiquement leurs réserves sur la volonté du gouvernement d'amorcer un véritable changement des réformes constitutionnelles... Six mois plus tard, des observateurs locaux et internationaux ont constaté des irrégularités et des fraudes électorales à chacune des trois étapes des élections parlementaires, le tout sur fond de violence et de chaos généré par des agents de l'État dans le but d'intimider les électeurs et de les dissuader de se rendre aux urnes. Au moins 11 citoyens ont péri lors de ces événements.&lt;br /&gt;Au début du mois de mai 2006, le Parlement, contrôlé par le gouvernement, a voté pour prolonger la loi d'urgence en vigueur depuis 25 ans. Le régime prétend que la loi d'urgence est nécessaire pour combattre le terrorisme, mais on ne peut que constater que le régime s'en sert depuis un quart de siècle afin de réduire au silence ses opposants et de les persécuter. Il existe toutefois une lueur d'espoir, baptisée la «révolution des juges».&lt;br /&gt;Depuis le début des années 90, les juges ont exigé, par la voix de leur association officielle, l'indépendance de la justice par rapport au pouvoir exécutif. [...] En 2000, la Cour suprême constitutionnelle a jugé que toute élection parlementaire devrait être tenue, conformément à la Constitution égyptienne, sous les auspices du pouvoir judiciaire. Le gouvernement a utilisé ce jugement à des fins de propagande pour légitimer le référendum constitutionnel et les élections de 2005. Toutefois, dans un rapport rendu public en juillet 2005, les juges ont remis en question les résultats des élections, affirmant que les mécanismes de supervision par les instances judiciaires n'avaient pas été mis en place de façon efficace. À la suite des élections parlementaires de décembre 2005, quelques juges téméraires ont exigé une enquête sur les incidents de fraude électorale et réitéré leurs exigences de supervision judiciaire complète du processus électoral. Deux de ces juges, Mahmoud Mekki et Hisham Bastawisi, ont lourdement payé leurs demandes : le gouvernement a formellement accusé ces juges de déshonorer le système judiciaire en parlant de fraude et les a envoyés devant un comité disciplinaire, un geste qu'Amnesty International a qualifié de «défi à l'indépendance judiciaire». Devant cette situation illégale et sans précédent, l'Association des juges a organisé un sit-in dans ses locaux et exigé l'annulation de la décision. Parallèlement, un autre sit-in a été organisé à l'extérieur des locaux de l'Association des juges par diverses associations et personnes. Malgré les arrestations et la brutalité policière, ces activistes provenant d'un vaste éventail d'horizons politiques ont exprimé leur solidarité et leur appui aux juges. Le 11 mai dernier, lors des premières audiences du comité disciplinaire, la police d'État a violemment réprimé les contestataires qui avaient pourtant usé de moyens pacifiques, indiquant par là que tout soutien aux réformes serait sévèrement puni. Des centaines d'activistes issus de tous les horizons politiques et sociaux, allant des Frères musulmans aux jeunes bloggeurs libéraux venus appuyer les juges, ont été brutalement battus et emprisonnés en vertu de la loi d'urgence. Des journalistes ont également été attaqués et empêchés de rapporter les événements entourant le comité disciplinaire et les manifestations. Une semaine plus tard, le comité disciplinaire a acquitté le juge Mekki. Quant au juge Bastawisi, il n'a pas pu se présenter lors de la séance finale du comité disciplinaire, ayant subi une crise cardiaque. Il a été réprimandé. D'autres scènes de violence et d'arrestations se sont produites dans les rues voisines du tribunal. [...] Un an après l'amendement constitutionnel de forme, la scène politique égyptienne n'a pas du tout changé. La loi d'urgence est encore en vigueur, non pas pour prévenir les actes terroristes mais pour étouffer toute dissidence et toute critique. Heureusement, des Égyptiens, tant en Égypte qu'ailleurs, réagissent. Un mouvement de protestation prend forme de façon graduelle. (In order to diffuse criticism, the government eased these impossible conditions for the first election, which is the only reason a presidential vote was held in 2005.)On the day the referendum took place, protesters peacefully opposing the amendment were beaten up by government agents under the watchful eyes of the Egyptian police. Six months later, local and international observers reported widespread voting irregularities and fraud in the three stages of the parliamentary elections. The days of the elections were replete with scenes of violence and mayhem perpetrated by state agents to intimidate voters and scare them away from the ballot box. The violence culminated in the death of at least 11 citizens.Fast forward to this month: The government-dominated parliament has approved the extension of the 25-year-old emergency law. The regime says this law is needed to combat terrorism, but anyone with a passing interest in Egyptian politics can easily observe how the regime has used it to silence and persecute its opponents.Yet, one ray of hope remains: the "revolution of the judges." Since the early 1990s, through their official association, judges have demanded complete independence from the executive branch of the government. They have presented a bill that will draw the lines between the executive and judiciary branches. Their demands were met by postponement.In 2000, the Supreme Constitutional Court ruled that any parliamentary elections should be fully supervised and managed by the judiciary in accordance with the Egyptian constitution. The government used this ruling as propaganda to add legitimacy to the constitutional referendum and last year's parliamentary elections; in a public report issued in July of 2005, however, the judges challenged the figures in officially reported results and claimed that the judiciary supervision during the referendum was not implemented in any effective way.Following the December parliamentary vote, a few outspoken judges demanded an open investigation into incidents of election fraud and reiterated their demands for full judiciary supervision over the election process. In an unprecedented, illegal and government-driven move, two high-ranking judges, Mahmoud Mekki and Hisham Bastawisi, were referred to a disciplinary committee and accused of dishonouring the judiciary by speaking out against fraud, a move that Amnesty International described as "a challenge to judicial independence."In response, the judges' association called for a sit-in at its headquarters and demanded the annulment of the decision. A parallel sit-in, outside the association headquarters, was organized by a broad range of groups and individuals. Despite arrests and police violence against them, activists and representatives from across the political spectrum continued to express their solidarity with the judges.On May 11, the day of the first hearing of the disciplinary committee, state police crushed the peaceful protests, clearly indicating that any voice seeking reform will be punished. Hundreds of activists, from the Muslim Brotherhood to young liberal bloggers, were dragged and beaten, then imprisoned under the auspices of the emergency law. Journalists were also attacked and prevented from covering the events of the disciplinary trial and the demonstrations. A week later, the disciplinary committee decided to acquit Judge Mekki and toreprimand Judge Bastawisi, who suffered a heart attack the night of the hearing and could not attend. The same scenes of violence and arrests were repeated.The fact that Judge Mekki and Judge Bastawisi, who are both vice-presidents of the Court of Cassation, have been presented to a disciplinary committee simply for criticizing the electoral process that the judiciary is officially responsible for overseeing shows how reluctant the Egyptian government is in pursuing democratic reform. All the judges demanded, through their association, was to investigate election fraud and to present a bill to parliament guaranteeing the independence of the judiciary.A year after the cosmetic constitutional amendment, the political scene in Egypt has not changed. The emergency law still prevails, and is used against democratic dissent, not terrorism. The regime is still trying to silence all criticism.Fortunately, Egyptians -- inside and outside Egypt -- are reacting to this situation, and a worldwide movement of protest is slowly organizing.
